Topic review - Respond to smear campaign
Author Message
Post subject:  Re: Respond to smear campaign  Reply with quote
Yes :doh_1: I had intended to mention that, but forgot while grabbing the appropriate links, etc. If you try and claim it as yours, it's not fair use. But, if you state where it's from, it is.

Tracy, I don't want to start a huge argument or anything I'd simply like a clarification. The quoted passage all sounds well and good but isn't/shouldn't there be an additional sentence that states all of that is only allowed IF the source is credited?? We were always taught in school and college growing up that if we used material from another source and included it in our papers and did NOT credit them then we were plagiarizing, IE passing off someone else's work as our own. Isn't that what's going on here? Again, I just want a clarification, no heated arguments :wave_1:

Before John tries to have this single page of his book pulled, I wanted to bring up fair use in the American copyright system and why you should not
even
try.

We have exceptions to the exclusivity provided by copyright - one such is known as "fair use." Fair use is described in Section 107 of the Copyright Law of the United States of America. Here's the relevant passage (Emphasis mine):

Quote:
Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright.

I hope the Administrators/Moderators don't mind if I rescue this thread from the abyss, but I don't want to start a new one, and I can't think of a better place to put this.

Well, the thing is that the same person who was so desperately demanding the removal of a warship profile here last year, has just recently published a new book on the battleship Bismarck. The following scan taken directly from this book is the latest copycat example from a guy who claims to have been researching the subject for more than 30 years. If you have a minute, please take a quick look at Otto von Bismarck biography and then compare it with the page located on my own website that I wrote myself more than 10 years ago right here:

http://www.kbismarck.com/otto-von-bismarck.html

The evidence speaks for itself.

EDIT: Photo scan taken from the book

I also tried to help by pointing out the weak points in his argument so that he could shore them up. I wanted to help because I am too an artist and the darn thieves are all of our problems.

Why don't you read through the thread before automatically labeling ALL of us as being against someone. I certainly don't appreciate false accusations and neither do the rest of us. We're all familiar with the age old saying about assuming...

Excuse me Jim; I tried to help him a couple of times and was either ignored or insulted. It is lunacy at that point to try and continue to help someone. John has poisoned his experience here from the start with his attitude and treatment of others.

C'mon John. If he stole your drawing a decade ago, fine. This Robocop approach isn't getting the drawings removed from this website and makes an open discussion most difficult.

Nope. Tried to give him the benefit of the doubt... I'd been told by others for a while that they had negative opinions of him, but I like to form my own opinions. Consider it forged.

His 'winning the hearts and minds' campaign isn't doing so well, I gather.... :heh:

I don't care what you say and think.

I was addressing the owner so mind you own business.

I reiterate that posting parts of images for discussion is also covered and allowed under US copyright as part of the Fair Use clause WHEN PROPERLY ATTRIBUTED. You can demand removal all you want, but if it's properly attributed and follows the fair use guidelines I posted in the Bismarck thread you have nothing but hot air and bluster.

Cadman,

I again demand that you remove my drawings and remove any links to my website. You have no permission to show this in your forum.

Rico,

I think you should stop your lies and stop using your forum to attack me as you have done in over a decade now.

You should give proper credit to Mr. López.

I don't think that would be necessary anymore Timothy, since he has just now changed the drawing in question on his website to a new one. The drawing that now appears in the following link is not the same that appeared only a couple of hours ago (see image attached on my previous post above) :cool_2:

Hopefully the new creation is of his own and not taken from someone else.

Hello everybody,

@ Cadman,

I agree with you Timothy.

Manuel surely deserves his credits :thumbs_up_1:

And he is NOT the only one which deserves his credits and recognitions ... and more to come on this one soon ...

Bye Antonio :thumbs_up_1:
