Hey, I'm no nay-sayer. I'm hoping the laws get changed myself... it's just not likely to happen if people don't know how screwed they are.
That said... were you a copyright lawyer? Would you hire a tax lawyer to represent you in a medical malpractice case?
Whether or not you charge for it is immaterial and would only affect the amount of damaged awarded in court if it went that far.... it's (and I'm not specifically referring to what you posted) still a violation of copright even if you don't make a red cent.
I can't believe this is still going on
The wallpaper photos are publicly released on the web by the filmmaker. The fact I altered them a little to make them cooler doesn't make a whit of difference. Besides, the way this works is that they send you a cease and desist letter before anything happens. Posting screen capture shots from a movie is so common on the Internet that I don't need to add anything.
The areas where this comes up is when large parts of copyrighted written works are posted (especially newspaper articles), or when a garage kit maker makes a sculpt of say, The Hulk, and Marvel Comics then 'shuts him down' via letter threat from an attorney. And those guys are selling the stuff for $$$.
Besides, the movie will never be released in the US anyhow. (I can't beliebv I am actually still replying to this post).
Look, if you want to impress us with your knowledge, feel free to do so. I know enough about the field that - even if you are correct - given the trivial subject matter and its non-commercial nature - the odds of what you're suggesting happening are 0.001% in my legal opinion.
And again, the worst thing that happens is that you get a legal letter, and if you comply, its all cool.
Its the people with large-scale copyright infringement profit operations that get involved in lawsuits.
Where have I violated the copyright law? Because I merely took the name of the film off digitally from the Yamato wallpaper shot (put on the web by the filmmaker for all to download freely) to make it look cooler? Or because I created that 'Musashi' diorama from the same photo?
Please. You surely have something better to do with your time.
